The Karnataka State Consumer Disputes Redressal Commission has found an obstetrician and gynaecologist of Tumkur not guilty of deficient service and has dismissed the appeal made by a consumer to enhance compensation for her complaint.
A resident of Tumkur, Chandrakala had consulted Dr Shubha Dwarak for the treatment of infertility. After a laproscopy conducted on her, the doctor prescribed Danazole tablets for the patient. She took the tablets and later suffered various symptoms. On the tenth day, the doctor prescribed medicines for gastric problems and also advised her to stop taking Danazole tablets.
The patient then got admitted to the Siddaramanna Hospital, Tumkur, where she was diagnosed of acute pancreatitis. She complained to the district consumer forum claiming deficiency in service on the part of Dr Dwarak. The district forum ordered Dr Dwarak to pay up Rs 1,00,000 as compensation to Chandrakala.

The Commission has also dismissed the appeal of the Oriental Insurance Co Ltd which had been ordered to pay up money to Mallikarjunaiah of Tumkur town by the district consumer forum. The company claimed that the driver in the vehicle did not have a valid driving licence. The Commission found that the district consumer forum was right in ordering Oriental Insurance to pay up the compensation to the consumer and dismissed Oriental Insurance’s appeal. “The driver did have a valid driving licence,” it has said.
