The anti-quota campaigners on Wednesday submitted before the Supreme Court that caste should not be the determining factor for backwardness to a person seeking privileges in elite educational institutions.
Submitting before a constitutional bench of Chief Justice K G Balakrishnan, Justices Arijit Pasayat, C K Thakkar, R V Raveendran, and Dalveer Bhandari, Senior Counsel Mukul Rohtagi said: “Caste cannot be the determining factor for backwardness to offer reservation to a section of the society.”
Mr Rohtagi read out a letter of Jawaharlal Nehru written to chief ministers on June 27, 1961. The letter reads: “I am grieved to learn of how far this business of reservation has gone, based on communal consideration. Let’s help the backward groups by all means, but never at the cost of efficiency. How are we going to build our public sector or indeed any sector with second-rate people?”
The 93rd amendment is an exercise in misguided power, Mr Rohtagi alleged.
