Viniv Inc Chief K N Srinivasa Shastry has moved the High Court against Bangalore Sessions Court’s order rejecting his bail application in three criminal cases.
A writ petition filed by Shastry through his wife Sathyalakshmi, has sought the common order by the Additional City Civil and Sessions Judge and In-charge Principal Sessions Judge, Bangalore, refusing bail to him and Viniv Inc Vice-President G Lokesh, to be quashed. It has contended the order passed on September 29, 2007 as lacking jurisdiction.
Special court
It contended that only the Special Court constituted under the Karnataka Protection of Interests of Depositors in Financial Establishments Act, 2004 can deal with the cases registered against Shastry.
The Principal Sessions Judge’s Court is the Special Court for Bangalore Metropolitan areas, it said. The Court allowed Government advocate to take notice and adjourned the hearing for 3 weeks.
