Police rapped for 'false' reports; to face inquiry

The division Bench headed by Justice V Gopala Gowda had issued a non-bailable warrant against five accused in a criminal contempt case.
Kempapura Agrahara police, who were to execute the warrant, said they couldn’t execute it since the accused were not found in their house.
But the accused were present before the court along with their counsels.
The Bench pulled up the police for false statements and ordered Police Commissioner to conduct a probe.
In another appeal, the Bench headed by Justice Chidananda Ullal ordered non-bailable warrant against Byregowda and two others.
Devanahalli police of Bangalore Rural district said they couldn’t execute the warrant. But the accused were already in court and said they had not had not received any warrant. The Bench ordered Rural SP to conduct inquiry against the officials and cancelled warrants issued against the accused.
Conviction order
A woman who filed litigations claiming retention of a temple and a hut built on a civic amenity area in Rajajinagar IV Block and advocate gained a conviction for criminal contempt of courts on Tuesday. A HC division Bench dealing with a complaint filed in 2001 by some residents delivered the judgement.
Complainants, D Bhaktavatsala and six other residents of IV Block, Rajajinagar, had accused B K Savithri and her advocate H Devendrappa of committing criminal contempt of court.
The complaint had said Savithri had filed a suit, an appeal and a petition in the name of Shree Shani Devara Seva Mandali seeking injunction against eviction of a temple and hut said to be illegally built by her grandfather in a civic amenity space in Rajajinagar IV Block.
Savithri’s suit and appeal were dismissed in 1995 and 2000 and her writ petition dismissed in 2001 as a vexatious petition.
She filed another suit in 2001 before the civil court seeking injunction against demolishing her hut.
Her advocate H Devendrappa was accused of actively participating in proceedings knowing fully about earlier litigations.
