Tribunal to have special sitting in Deendar case on Jan 28

The Unlawful Activities (Prevention) Tribunal for Deendar Anjuman will hold a special one-day hearing on January 28, 2008 in Bangalore.


Justice Mukul Mudgal, of Delhi High Court, who is heading the tribunal,  took the decision after five witnesses from Tumkur and Bangalore appeared before the court on Thursday requesting to file affidavits.

Friday being Bakrid, is a public holiday and on Saturday Basheer one of the undertrials held for alleged involvement in the 2000 church blast case in Central Prison at Parappanna Agrahara, will depose before the Tribunal. Defence counsel Mushtaq Ahmad pleaded that he will not be available on Saturday to cross examine the new witnesses Khaled Baig Nadvi, Muneer Ahmed Qasim, TR Akbar Khan, all from Tumkur, Maulana Iftekar Ahmed Qasim and Maulana Zainul Ahmed Saheb, Bangalore.

Mr V S D’Souza, SP, State Intelligence deposed before the Tribunal on Thursday to plead for the continuation of the ban.

When asked by Mr Ahmad what proof he had regarding any fresh activities of the Anjuman as alleged by him, the police officer said there’s an intelligence report on the activities of the proscribed organisation. There’s a red corner notice on the CBI website against the main accused of the serial church blast cases Zia-ul-Hassan and his four sons, who are reportedly based in Pakistan.

When the defence counsel questioned Mr D’Souza what action has the State police taken to get the accused, he said they obtained non-bailable warrants from the court and the red corner notices.

On an allegation that Zia-ul-Hassan had visited Bangalore along with his sons, Mr Ahmad asked for the proof.

“He visited Bangalore on a visitor’s visa in 1999. Moreover, there is an entry in police commissioner’s office. He stayed in the house of Mohsin Chitradurgi, father of Siddique, who died in the van blast. Mohsin’s house is on Church Street, Sonappa Block, JC Nagar, Bangalore,” replied Mr D’Souza.

The defence counsel then asked whether the prosecution has moved a fresh application in the four church blast cases, Mr D’Souza said that they had moved a new application to add Sections 121 (waging war against the Union of India) and 121 A (to conspire and acquire weapons and explosives to wage war against the country) of the IPCS before the Special Court at Parappanna Agrahara where the cases are being tried.
