Cellular Operators Association of India (COAI) on Wednesday said it had served a legal notice on the Department of Telecommunications (DoT) “cautioning” it against granting GSM spectrum to CDMA operators till the pendency of hearing of a related case in the Delhi High Court. The notice, COAI sources said, stated that any attempt to proceed with the allotment of GSM spectrum to CDMA operators pending a court decision would be “an act of impropriety” and would “amount to over-reaching and pre-empting” a court decision.
According to the sources, the notice referred to recent media reports saying that the DoT had decided to proceed with the allotment of GSM spectrum to CDMA operators.
