Justice Anand Byra Reddy passed an interim order to this effect, in course of a petition by CMH Shops & Establishments and Residents Association and others.

The petitioners have sought a change in the present alignment of Metro Rail project.

‘Don’t interfere ’
 The High Court on Monday directed BBMP not to interfere with Purvankara Projects Private Limited’s “right” to rebuild its compound on its land in Binnamangala village in Bangalore East taluk. The Court termed the BBMP officials earlier action in demolishing a portion of the wall as “illegal” and “high handed act” while also restraining any further demolition or trespass.

Justice Mohan Shantan Goudar passed an order to this effect while allowing a 2006 writ petition by Purvankara seeking writ of prohibition against BBMP’s interference with its construction. The Palike had contended that it had demolished the wall since it had blocked the Raja Kaluve.

Plan  extension
While allowing another prayer by Purvankara, the Court also directed BBMP to extend validity of the sanctioned plan for construction, granted to Purvankara earlier, for a further period of two years without imposing any additional liabilities.
