The revision plea was filed by the police and will come up for hearing before the principal sessions judge Ashok Bhangale on February 4.
Special public prosecutor R R Kini told the court on Thursday that the police should be given a fair chance for investigation as they had not been given custody of the accused.
The accused were released from the jail on January 8 after they provided sureties of Rs 10,000 each.
The metropolitan court had granted bail to the accused on January 3, hours after they were arrested in connection with the molestation of two NRI women by a mob of around 50 people outside a five-star hotel in suburban Juhu.
After a massive public outrage and the Maharashtra deputy chief minister R R Patil’s snub, the police swung into action and arrested 14 accused.
However, the main accused, a man in white shirt seen tearing a victim’s cloth, is untraceable. The victims, one of whom married just a day before the incident, refused to file police complaint as they could not remember the faces of their tormentors.
The police complaint has been filed by the two photographers of a newspaper, who identified the accused in an identification parade.
The accused, however, have denied involvement and said they were passing by the area and rushed to the scene on hearing noises.
