HC awards medical seat to disabled girl

Gupta was denied admission an MBBS seat on grounds of her disability.

In a judgement which gave needed relief to a physically challenged girl Vishakha Gupta, the Patna High Court has directed Bihar government to ensure that she gets admission in any medical college in the state. If no vacant seat exists, then a special seat should be created for her, the court has ruled.

Gupta was denied admission an MBBS seat on grounds of her disability. She had cleared the Bihar Combined Entrance Examination (BCEE) last year and was about to join the course when a team of orthopaedic doctors from Nalanda Medical College and Hospital found her unfit for the medical profession saying she had a spinal problem.

Vishakha challenged the board’s decision before a single judge bench of Patna HC, which ordered a fresh medical examination of Gupta by orthopaedicians of Patna Medical College and Hospital.

This time the doctors declared her fit to pursue the course. The High Court directed the government to ensure her admission in any medical college in Bihar.

The fresh report was, however, challenged by the BCEE in the higher bench of the High Court.

But the division bench of the High Court, comprising of Chief Justice Rajesh Balia and Justice Chandramauli Kumar Prasad, on Tuesday, upheld the earlier verdict.

It asked the BCEE board to ensure her admission in any government medical college using either an existing vacant seat, or by creating a special seat for Vishakha Gupta.
