Justice N Anand passed an order to this effect while allowing a petition by Shiva Rajkumar against the Additional Chief Metropolitan Magistrate of Bangalore order of July 2005. In a cheque bounce case lodged by Shiva Rajkumar against one Venkatesh, the Magistrate had ordered re-recording of his evidence following an application by accused Venkatesh.
It was said that Shiva Rajkumar had in 1998, purchased a property near Geddalahalli said to be belonging to one C K Suresh through his GPA holder Venkatesh. Later it was revealed that the property belonged to BDA. While Suresh agreed to pay the amount back, Shiva Rajkumar had claimed Rs 15 lakh compensation from GPA holder Venkatesh.
Shivaraj Kumar had purchased the property from Venkatesh and had got cheated. It was said that five cheques issued by Venkatesh had bounced.
