Ayodhya case adjourned

The Supreme Court on Friday adjourned the case challenging the transfer of the Babri Masjid demolition cases, which involves senior Bharatiya Janata Party (BJP) leader L K Advani, to the Rae Bareily court for six weeks.

A bench headed by Chief Justice K G Balakrishnan said the petition field by Wajhat Ansari would be heard by the court after six weeks.

Advocates Arun Jaitley and Ravi Shankar Prashad appearing for the BJP leaders submitted that the petition should be dismissed as a similar petition filed by Aslam Bhure was dismissed by the apex court earlier.

Besides Advani, the leader of opposition in the Lok Sabha, the other accused in the case are former Union ministers Murli Manohar Joshi and Uma Bharti as well as Vishwa Hindu Parishad (VHP) leaders Ashok Singhal, Giriraj Kishore, Vishnu Hari Dalmia, Vinay Katiyar and Sadhvi Ritambhara.

Soon after the demolition of the mosque on December 6, 1992, two police complaints were registered No. 197/92 and No. 198/92.

The Uttar Pradesh government in consultation with the Allahabad High Court issued a notification on September 9, 1993 transferring the No. 197/92 case to a special CBI court. But as the No. 198/92 case was not covered by this notification, an executive order was issued on October 8, 1993 for its transfer. Till February 2001, trial in both the complaints proceeded in the same court.

The special court framed charges against 47 people in the first complaint and Advani and seven others in the second complaint. But on revision, the High Court by an order in February 2001 quashed the charges against Advani and others on the technical ground that the transfer of the case was made without consulting the High Court and hence it was illegal.
