The Karnataka High Court on Thursday ordered notices to the Banashankari police and a minor girl represented through her mother, over her father’s petition seeking to quash a criminal intimidation case allegedly registered upon her complaint.
A criminal petition filed by a city resident, Kumar V Jahgirdar, stated that a criminal case had been registered by the Banashankari police pursuant to a complaint in the name of his 13-year-old daughter, who is now in the custody of her natural mother and his former wife, Chetana Kumble.
He stated that his daughter was in the custody of Chetana Kumble, now married to cricketer Anil Kumble, as per a court order which had granted him only visitation rights for one day in a week. But, a false engineered complaint in the name of the minor child was filed on August 26, 2007 stating that she apprehended danger to her life from him, the petitioner alleged.
The complaint, he said, was filed when the minor was in her mother’s custody and when the case for her permanent custody was pending between him and her mother, Chetana Kumble.
The petitioner termed it an abuse of the process of the court, seeking the court to quash the proceedings.
The court ordered notice to the minor girl through Chetana Kumble after allowing the petitioner’s counsel to amend the cause title to the effect that she was represented by her guardian mother.
