Criminal proceedings to be launched against defaulters

The chief ministers office had requested the Lokayukta to give Mr Kumaraswamy a grace period of 30 days, to file his financial details since his chartered accountant had met with an accident and he was unable to file them timely.

  Lokayukta Justice Santosh Hegde may not be able to give extension to any of the defaulting legislators to file their assets and liabilities, the deadline for which ended on June 30, 12 midnight.

The chief minister’s office had requested the Lokayukta to give Mr Kumaraswamy a grace period of 30 days, to file his financial details since his chartered accountant had met with an accident and he was unable to file them timely.

“Under the Lokayukta Act, I’m not in a position to give him any extension. Like the other legislators, who have failed to file their assets and liabilities by June 29, I will also issue a notice to him, giving him two months’ time to submit his financial details,” said Justice Hegde.

He said letters will be issued to all the 25 MLAs and 8 MLCs who have not submitted their assets and liabilities on Monday, and two months time will be given to them to file the details.

Report to Governor
“I will also submit a report of the defaulters to the Governor. The names of those who do not file their details even after two months, will be published in three leading newspapers. I will also execute criminal proceedings against them under Article 176 of the IPC, for not furnishing required information to a public servant,” he added.
The offence under the Section amounts to one month simple imprisonment or fine of Rs 500 or both.

“Mr Raju was an MLC till recently. I need to find out whether he needs to file his financial details,” said Justice Hegde.
