Prosecution stayed The High Court on Wednesday stayed the proceedings for the prosecution of Secretary of Shivagangagiri Vidyabhivrudhi Samsthe of Chickmagalur district and the principal of a PU college run by it.
Samsthe Secretary B Maralappa and GM Omkaramurthy, principal of Samsthe’s Shivagangadhara Independent PU Arts College in Kunkanadu, Chikmagalur district, had appealed against a single judge order directing their prosecution under Karnataka Education Act.
The single judge had directed the prosecution in the course of a writ petition, while observing that the college had admitted students during 2006-07, despite a prohibition by Education Department and the management’s undertaking to restrain from admissions. The division bench headed by Chief Justice Cyriac Joseph, which is also hearing the Samsthe’s appeal with regard to college’s recognition, passed an interim order staying further proceedings for the prosecution ordered by the single judge. The stay was granted for three weeks.
Transfer of students allowed A HC division bench on Wednesday, directed the State government and Rajiv Gandhi University of Health Sciences to arrange for transferring three final year MBBS students of a medical college, pending recognition, to some other recognised medical college in the State.
The appeal by SN Bhagirath, Govindarajalu and Santosh Kumar, had sought the Court to facilitate their transfer from Basaveshwara Medical College of Chitradurga, which is due for a recognition by Medical Council of India (MCI).
Admitted to the college under government quota seats during 2001-02, the three students had stated that the college’s permission for admissions had not been renewed for subsequent years.
They had refused to take up final examinations held in March 2006 through the college, apprehending that their degrees would not be recognised. They had also pointed out that MCI had refused recognition to the college after an inspection in September 2006, and the college’s recognition process was still underway.
The college stated before the Court that it had no objection for the students’ transfer and following this, Court directed the government and RGUHS to arrange for the same. The Court clarified that this was a relief in the peculiar circumstances of the case and would create no precedence for such mid-term transfers.
About 200 other students of the same college had withdrawn their similar pleas, last week, while choosing to stay back with the college.
