As a consequence, it would be mandatory for all heavy vehicles getting newly registered, to install speed governors.However, the Court refused to interfere with the State government decision in granting breathing time to the owners of the vehicles already on roads, till the end of the year.
An interim order to this effect was passed by a Division Bench comprising Chief Justice Cyriac Joseph and Justice BS Patil. This followed a PIL by City resident YN Nanjappa, challenging the notification dated June 29, 2007, which had deferred the implementation of a 2006 notification prescribing last dates for installation of speed governors in all heavy vehicles.
During the hearing on Tuesday, the Court considered an affidavit filed by Transport Secretary KS Sridhar which had explained the circumstances under which the Government had deferred the implementation.
The Secretary had stated that State government had decided to defer the move, following vehicle owners’ representations against installation and in anticipation of a National Road Safety Policy, expected to frame uniform norms for all the states. The Centre has appointed a Committee to deal with the states’ problems in implementing road safety measures, he had said.
Direction to VTU
The Court directed VTU and AICTE to conduct an inspection of Nadiger Education Society’s Engineering College in Bangalore, and submit a report with specific details. The order followed an appeal by the management of the college which has been disaffiliated from VTU on the ground of lack of infrastructure. The management claimed that the college possessed required number of faculty, as against the VTU Local Inspection Committee report saying that it had shortage of faculty.
The Court ordered VTU and AICTE Inspection authorities to hold an inspection on July 21 and submit a report by July 24. It also appointed an advocate commissioner to accompany the inspection team.
