A bench comprising judges Shah Abu Nayeem Muminur Rahman and Jubaer Rahman Chowdhury allowed her lawyers led by ex-attorney general Rafique-ul Huq to move the writ.
Her lawyers said Emergency Powers Rules could not cover the allegation brought against the former premier as it took place before the state of emergency was proclaimed on January 11 this year. Hasina earlier said the charge brought against her by a Bangladeshi businessman was “false” and part of a plot to “annihilate” her.
The writ was filed as Hasina’s lawyers yesterday received the signed copy of the power of attorney from Sheikh Hasina through jail authorities, which was required for filing the case. “We believe that she (Hasina) will be freed through the legal battle. We will decide on the next course of action after reviewing the overall situation,” acting president of the party Zillur Rahman said after a meeting of senior AL leaders and lawyers.
