Delay in local body polls is against law

Chairman of Administrative Reforms Commission M Veerappa Moily has said that the State government should take steps to hold elections to Bruhat Bangalore Mahanagar Palike, Mangalore City Corporation and Mysore City Corporation.

Chairman of Administrative Reforms Commission M Veerappa Moily has said that the State government should take steps to hold elections to Bruhat Bangalore Mahanagar Palike, Mangalore City Corporation and Mysore City Corporation.
In a letter to Chief Minister H D Kumaraswamy, Mr Moily said that as per the Supreme Court judgement election for any body cannot be deferred citing delay in revising electoral rolls as reason. According to the judgement given in the case of Kishansing Tomar Vs Municipal Corporation of the city of Ahmedabad any revision in electoral rolls has to be done before the completion of the term. If it cannot be done before the completion of the term election has to be conducted mandatorily based on existing electoral rolls itself.
He said delay in holding elections is against the mandate of constitution of India. “Administrators are governing all three corporations violating the mandatory provision of the constitution of India,” he said. Mr Moily said the election commission can move the high court for immediate decision and declare election for all three corporations.
