Sabharwal case transferred to Nagpur

The Supreme Court on Wednesday ordered for the transfer of the trial of the Professor H S Sabharwal murder case to Nagpur from a court in Madhya Pradesh.


A bench of Justices Arijit Pasayat and P Sathasivam said for the better interest of justice the trial of the murder case has been transferred from Madhya Pradesh, which is governed by a Bharatiya Janata Party  government. The court directed the trial court to complete the trial in eight months.

Advocate U U Lalit, appearing for Madhya Pradesh government submitted that the case may be transferred to Nagpur, which is in a non-BJP ruled state and closer to Madhya Pradesh.

“It is up to the court to decide on the prosecutor. The court may recall about 140 witnesses who have turned hostile when the trial was on in Madhya Pradesh,” said Mr Lalit.

Meghalaya suspense
The Supreme Court on Wednesday has refused to pass any direction to prepone the date of trust vote in Meghalaya scheduled for March 21. The Apex court has taken this decision saying that the new house will need time for its formation.

“Moreover, who will take the responsibility to summon the Assembly? Which of the respondents will take responsibility to convene it?’’ said a Bench headed by Chief Justice K G Balakrishnan.

Soli Sorabjee appearing for Conrad K Sangma, NCP MLA, urged the court to advance the trust vote scheduled for March 21. The Court expressed its inability to pass such direction and said that the Governor invited the leader of the largest single party to form the government. The court fixed March 24 for the hearing of the petition in detail.
