Insurance company pulled up

A HC bench deprecated Oriental Insurance Company Ltd for causing impediment in disposal of its appeal against a 2002 accident claim award related to a 1989 accident, and for adopting various dilation tactics.

 The case was running for a period of 19 years, the Bench noted, while considering an interlocutory application from the company.
The company has challenged Claims Tribunal’s award for Rs 6.6 lakh compensation in favour of Pukhraj Dhoot, suffering grievous injuries in an accident. It had sought dispensation of notice to vehicle owner earlier, but later sought to limit its liability to Rs 50,000 only and moved an application to serve notice to the owner. The Court allowed the application imposing Rs 2,000 costs. While also observing delay in depositing a portion of impugned compensation award, the Bench directed the company to disburse Rs 2.5 lakh amount in favour of claimant, by March 17.
