A habeas corpus writ petition filed by a young man, alleging illegal detention of his “wife” by her parents, was dismissed on Monday.
The petitioner, Abdul Latif G of Karambaru, claimed that he and a Muslim girl studying with him had entered into a registered marriage at Mangalore on October 31, 2007. However, since the marriage was not acceptable to her parents, they have illegally detained her, he had alleged. Following Court’s order, the girl, along with her parents, appeared before the Division bench on Monday. The girl told the Bench that she is not willing to stay with the petitioner, and that she has filed a petition before a Mangalore court for dissolution of their marriage on the ground of fraud. The Bench observed that habeas corpus petition does not survive as the girl was not in wrongful confinement and dismissed the same.
