The Karnataka High Court has granted interim relief to a group of petitioners who challenged the Karnataka Industrial Area Development Board’s notification to acquire nearly 100 acres of their land in different villages in Hospet taluk.
The notification had come as a renewed threat of displacement to the petitioners, who had earlier been dislodged from their land at the Tungabhadra dam site. With the construction of the dam, the government had rehabilitated them by providing them with land at Mariyamanahalli, Danapur and other villages.
With the KIADB notification, Ashwathamma and several others from Hospet were under the threat of displacement from the villages to where they had been relocated.
Notification
While the preliminary notification for acquiring --“for industrial purposes” -- their land came on August 31, 2006, the final notification was issued on April 7.
The aggrieved parties have told the court that they will have nowhere to go if displaced a second time. They also contended that they were not given a hearing before the notification was issued.
Justice A C Kabin ordered KIADB not to displace the petitioners for a period of three weeks and adjourned the matter for further hearing.
