The State Assembly is likely to be dissolved after Parliament approves the presidential proclamation and Union cabinet recommends dissolution of the house to the governor.
The business advisory committees of both the houses have decided to introduce the resolution for approval, to be followed by a debate. President Pratibha Patil had issued the proclamation on November 20.
As per the Supreme Court judgement in the Bihar case, president’s rule has to be ratified by Parliament with 60 days of the notification. However, the governor has to decide whether the house should be dissolved or kept under suspended animation. Such a decision does not require separate Parliamentary approval.
Once Parliament’s okay is obtained, the cabinet is likely to lose no time to recommend dissolution of the house to the governor. The presidential proclamation, tabled in both houses on Wednesday, is likely to be introduced on Monday or Tuesday.
As per the legal process, the notification is only for imposition of Central rule-not for dissolution or suspension of the Assembly.
The proclamation was based on a report sent in by Governor Rameshwar Thakur on November 19, in which he recommended that the Assembly be either dissolved or kept under suspended animation.
