The complainant’s son Lokesh, aged 20, had fallen at his house in Banashankari from a height of 20 feet and suffered severe head injuries on March 18, 2005.
He was rushed to NIMHANS at around 6 pm, where surgery was performed between 10 and 11 pm. At around midnight, NIMHANS urged the family to shift him to another hospital as it lacked ventilator support which the patient needed. He was taken to Abhaya Hospital where he died during the early hours of 19-3-2005.
His family complained to the IV Additional Forum, (claiming that if all possible help had been given to their son earlier at NIMHANS, he would have survived) which had awarded them Rs 3 lakh as compensation.
NIMHANS went in appeal against this order to the Karnataka State Consumer Disputes Redressal Commission, Bangalore, claiming that NIMHANS doctors had done everything possible within the five critical hours to help the patient.
The commission president, Justice Chandrashekaraiah, and member M Shama Bhat ruled that there had been no dereliction of duty by NIMHANS and dismissed the order of the IV Additional Forum.
Trauma Centre wins against consumer
H P Krishna from Hassan had gone to Manjunath Orthopedic and Trauma Centre in Hassan for treatment of his low back pain.
He was treated by Dr K C Manjunath, the consultant orthopedic and trauma surgeon, who operated on him. Later, he claimed that he suffered from various ailments that finally resulted in his becoming impotent.
He had complained to the Ist Additional District Consumer Disputes Redressal Forum, Bangalore, against the Manjunatha Orthopedic and Trauma Centre and against Dr K C Manjunath. He accused them of negligence.
The Ist Additional Forum had dismissed his complaint. He appealed to the Karnataka State Consumer Disputes Redressal Commission, which found that there was no negligence on the part of the centre or the doctor.
The commission dismissed his appeal and confirmed the order of the Ist Additional Forum.
Insurance firm to pay Rs 30,000
Hanumantharayappa had gone in appeal to the Commission challenging the order of the district consumer forum which had dismissed his complaint against The New India Assurance Co Ltd.
His wife had been treated for abdominal pain by a hospital for which he had paid Rs 30,000 for treatment. But the New India Assurance Company did not reimburse the money when he made a claim. He filed a complaint against it with the district forum which dismissed it.
But when he went in appeal against this order to the commission, it ruled in his favour, and ordered the New India Assurance Co to pay Rs 30,000 to the complainant with an interest of about six per cent per annum from the date of the complaint till realisation.
