Dismissed professor to be reinstated

The court has ordered the OSC Educational Society that runs the SMS college in Brahmavar to reinstate the dismissed History Lecturer Prof Emmanuel Lalith Kumar immediately.

According to a press release, the court observed that the dismissal order of the management without any enquiry and reasons is against the principles of natural justice.

 The court stated that the management who is the protector of interests of the employees has to apply its judicious mind to the facts and circumstances of the case and an opportunity should be given to the employee.
It further observed that the management has virtually violated the provisions under Section 92 of the Karnataka Education Act and Rule 38 of the Karnataka Educational Institutions (Collegiate Education) rules, 2003 and thereby committed a serious error which no court can tolerate.

The tribunal remarked that the management with the principal, has taken a ‘hasty and nasty’ decision.
