Bail order allegedly defied; Court seeks reply from SP

The High Court on Thursday sought a reply from the Superintendent of Central Prison, Bangalore, over the allegations made by a convict that he was sent behind the bars without honouring the Courts recent bail order.


Venkoba Rao, convicted and sentenced to 7 years imprisonment by I Additional Sessions Court of Kolar on the charges of rape in 2005, was in Central Prison. But HC had also passed an order suspending the penal sentence and granting him bail till Oct 31. The Court had directed him to the obtain bail order from the trial court after furnishing bail bond and surety worth Rs 30,000 each.On Thursday, an application moved on behalf of Venkoba Rao, came before the Court in which it was stated that he appeared before the trial court and obtained the bail. But, when he went to the prison authorities on Oct 23, with the Court’s bail order, the prison authorities did not respect the order but, took him to custody, it was alleged. Further it was alleged that the jail officials abused Venkoba Rao’s son and uncle who had accompanied him, and demanded Rs 20,000 for releasing him.

Justice AC Kabbin, directed HC Registrar (Judicial) to forward a copy of the application immediately to the Superintendent of Central Prison.
