Khanambee of HD Kote taluk, Mysore, had filed a habeas corpus petition alleging illegal detention of her son by the Mysore police. At an earlier hearing of this petition, the High Court had observed that the statement filed on Aug 20 by SPP S Dore Raju on behalf of Mahadevappa, Inspector of CCRB, Mysore, had several documents dated Aug 26.
The Division Bench comprising Justice KL Manjunath and Justice Jawad Rahim had sought an explanation for this anomaly, and had also heard Mysore Police Commissioner, summoned at the previous hearing.
The Bench which heard the SPP on Friday, sought clarification on the contradictory statements forthcoming in case and regarding those post-dated documents. The Bench directed the Commissioner to file an affidavit while granting time to SPP for filing his explanation on the issue, and posted the case to November 2.
Alienation
The High Court on Friday admitted a PIL seeking directions to the Gulbarga Urban Development Authority and Gulbarga City Corporation to take steps to retain and maintain the civic amenities spaces earmarked for a park and playground in a private layout in Gulbarga.
The petition filed by Bheema Shakti Yuvak Sangh of New Ghatge Layout formed in Biddapur village, Gulbarga taluk, stated that civic amenity sites no. 2, 3 and 4 in the Layout had been reserved for the purpose of park, playgrounds, and other public utilities. But the civic authorities had allowed one Ranjit Ghatge of the Housing Society, to alienate the sites to third parties - Dr Mahendrappa Dasankar and three others - it alleged.
The Division Bench headed by Chief Justice Cyriac Joseph admitted the petition while ordering
notices to the authorities.
