The High Court on Friday refused to stay the criminal proceedings pending before a Bangalore City Sessions Court, against a KAS officer for charges of amassing wealth disproportionate to his known sources of income.
M Krishna, a KAS officer working as Principal of District Training Institute, Tumkur, has petitioned the High Court seeking to quash the criminal proceedings initiated against him by Lokayukta police and the Government sanction granted for the same.
In an interlocutory application moved in course of this petition, he sought the Court to stay further proceedings in the case, while stating that Lokayukta police had filed chargesheet in August 2006 without taking relevant facts to consideration. The proceedings were now stated to be at the stage of hearing the accused on charges.
Justice Ram Mohan Reddy refused to stay the proceedings at a stage after the chargesheet had been filed. However, the judge directed the Additional City Civil and Sessions Judge, Bangalore before whom the matter is pending, to expedite the proceedings.
The judge directed the Sessions Court to hear the petitioner on charges and proceed to record evidence of prosecution, and complete the same within one year.
Nursing school
The High Court on Friday directed the Indian Nursing Council to conduct inspection of a Nursing School run by Sagar Gangotri Education Trust of Sagar, Shimoga district and two other nursing colleges for considering grant of suitability certificates, within two months, while disposing of the institutes’ applications.
The applications were filed in the course of a suo motu PIL initiated by HC with regard to inadequate infrastructure in some nursing institutes of the State. Previously, the Court had passed an interim order barring admissions to nursing institutes lacking requisite suitability certificates from INC and approval from State Nursing Council. The Court deferred the hearing of certain other applications by some nursing institutes barred from admissions, seeking direction for approving their admissions, till the time they obtained suitability certificates from INC.
HC pull up police
The High Court pulled up Chikkajala police for not being able to apprehend the alleged kidnappers of a Hunasamaranahalli Gram Panchayat member while seeking proper explanation from Chikkajala and Devanahalli police officers in this connection.
During the course of a habeas corpus petition, the Bench comprising Justice K L Manjunath and Justice Jawad Rahim had directed Chikkajala and Devanahalli police to take all steps to arrest five persons including two GP members, accused of kidnapping GP member Ramesh. The Court gave a last chance to the police to explain why they had not arrested the two accused GP members when the two had come to vote at the GP’s presidential polls held recently. The case was posted to next Friday.
