The Bombay High Court on Thursday directed actor Shah Rukh Khan to file within two weeks, an affidavit regarding alleged violation of DC rules while constructing his new bungalow off Bandra’s Mount Mary road.
Apart from Khan, a division bench comprising Chief Justice Swatanter Kumar and Justice D Y Chandrachud, also directed the Brihanmumbai Municipal Corporation to file their reply on a Public Interest Litigation seeking demolition of Shah Rukh Khan’s newly-constructed bungalow, adjacent to his existing bungalow “Mannat”.
BMC plan flouted
The PIL, filed by Bhrashtachar Nirmoolan Sanghatana, has alleged that the actor has violated the BMC’s sanctioned development plan in connivance with its officials.
The petitioner alleged that BMC officials had favoured the Bollywood star by reducing the width of an adjacent road by three metres.
Petitioner’s lawyer Shakuntala Joshi, while showing photographs, contended that the balcony of Shah Rukh Khan’s new bungalow was encroaching on the road, which otherwise should have been few feet inside the proposed roadline.
The sanctioned DP shows the width of the proposed road as 9.15 meters, whereas now only 6.15 meters width has been left, she added.
Shah Rukh Khan’s counsel told the court that the allegation was baseless as the BMC had approved of the plans.
While considering another point in the petition regarding alleged illegal construction of “The Mall” on S V Road in Malad, the court came down heavily on an executive engineer of the BMC for filing a “patently incorrect” affidavit, which according to the court gave no particulars, no details of the construction.
The court directed the concerned officer to remain present in the court on the next date of the hearing on September 20.
