The Supreme Court on Monday dismissed a Public Interest Litigation (PIL) of a Mumbai-based IITian seeking a direction to the UPA for a discussion on the Indo-US nuclear deal on the floor of Parliament. The apex court said It’s a policy matter and we do not interfere in it.”
A bench headed by Chief Justice K G Balakrishnan said, “The Court does not have the authority to interfere in policy matters and it is the prerogative of the Government whether to discuss the matter in Parliament or not.”
M N Ramamurthy, appearing-in-person, submitted that very few MPs, political parties and people support the 123 nuclear agreement between India and the US . “The prime minister cannot take any arbitrary decision in a democratic country,” he said forcing his points.
Provisions in the treaty say, India cannot carry out nuclear tests in the next 40 years. It would put the nation in jeopardy as many hostile countries are its neighbours, said Ramamurthy.
If the treaty was not discussed in Parliament, at least it should be referred to a Joint Parliamentary Committee for scrutiny, he said.
