Bappi Lahiri moves Delhi HC against Toonpur Ka Superhero

Last Updated 21 December 2010, 13:42 IST

The Ajay Devgan and Kajol starrer movie is scheduled to be released on Friday. The character Guppy, a singer in the movie looks similar to Lahiri, the king of disco right down to the multiple gold chains, the petition alleges.

Justice S Ravindra Bhat today issued a notice to the film's director Kireet Khurana of Eros International Entertainment and producers-Kritika Lulla of Big Screen Entertainment and Kumar Mangat Pathak of Climb Media and sought their responses by Thursday.

Filing an injunction suit against the filmmakers through counsel Sandeep Mahapatra, Bappi Lahiri sought deletion of Guppy from the movie saying the character has resemblance to him and it wrongly gives the impression that the composer is part of the film.

"The character Guppy, which was stated earlier nothing but an animated version of plaintiff(Bappida), has violated the right to privacy and publicity and also severely dented and injured his goodwill and reputation and it has defamed him in the eyes of the public at large," the counsel argued.

The counsel argued the producer and director have not obtained permission from him before projecting his identity and sought the court's order restraining the distributors from releasing the CD and DVD.

The court fixed Thursday for further hearing of the matter.
