BDA babus engineer a scam

According to a report by BDA secretary, M V Vedamurthy on the recent controversy over possession of sites in the layout the vested interests even managed to get a High Court order in their favour, by misleading the court.

“A few vested interests created bogus title deeds to claim ownership and misled the court,” the report said. BDA has allotted 410 sites in these two blocks, located on survey number 38 and 39 at Giddadakonenahalli in Yeshwantpura hobli.

High demand
The sites allotted by BDA are in high demand among property buyers, as they are considered to have ‘proper documents’.

In this case, the property owners were in for a shock a few days when they noticed a few people constructing huts on the sites, claiming  that the land was allotted to them in 1973, under a programme for economically weaker sections. As many as 28 such ‘allottees’ had moved the High Court in 2008 and secured an order in their favour.
The court order was enough for BDA engineers of the west division to turn down building plans of the rightful allottees. The aggrieved allottees appealed to higher officers in BDA, including the commissioner to stop illegal constructions in the layout.

Hemanna, a site owner, said that officers had allowed unauthorised people build huts in the layout. The engineers refused to sanction the building plans to Hemanna, though he had all documents supporting his ownership. “I bought the site from BDA. But BDA officers are not allowing me to construct a house,” he said.

In his report dated December 6, 2010, Vedamurthy stated that the land was acquired for a BDA layout, by following set procedures.

The authority had addressed all objections received at the time of acquisition. The report says that sites were not allotted to anyone in the survey numbers in 1973. 

Further, the report said the executive engineer and two assistant executive engineers had been refusing to approve the building plans, though there were no directions from the High Court in this connection.

The officers are said to be Shreedhar Murthy, Sambandha Murthy and Krishnappa, though the report does not name them,mentioning only their designations.

The report recommended that disciplinary action be initiated against the engineers for allowing vested interests to construct sheds and huts, encroaching upon BDA sites.
It also recommends that the building plans of the BDA allottees be approved and that the sheds and huts constructed by illegal occupants be demolished.

B M Shivakumar, President of JP Vichara Vedike, which is fighting for the rights of BDA allottees, said the BDA should take strong action against those trying to deprive genuine allottees of their due.
