<p>"The Sessions Court has quashed the magistrate order of discharging Bhatt, her company 'Fish Eye', co-producer Sujit Singh and his Shreya creations," said advocate Virendra Jabra, appearing for social activist Vinod Jain, who had approached the sessions court challenging the magistrate's order.<br /><br />Jabra said that the sessions court has also directed the Chief Metropolitan Magistrate to assign the case to a new magistrate who would conduct the trial.Pooja Bhatt's lawyer Mangesh Patel refused to comment.<br /><br />Some people took objection to the poster of the 2005 film 'Rog', alleging that it depicted the film's lead actress South African Model Elina Hamman in a skimpily clad manner, which was obscene.<br /><br />Later, police registered a case of obscenity against six persons, including Bhatt.<br />On July 14 2008, the Bandra metropolitan magistrate's court had discharged Bhatt, Singh and their companies saying that there was no sufficient evidence against them. This order was quashed by the sessions court today.<br /><br />Earlier, a magistrate court, in March 2007, discharged Hamman and director Himanshu Bhramabhatt from this case but it was challenged in the sessions court, which quashed the discharge order.</p>
