HC dismisses BBMP plea on tax
The High Court on Wednesday dismissed an appeal by the Bruhat Bangalore Mahanagara Palike (BBMP) challenging the single judge order quashing the levy of tax on advertisements on business establishments and shops.
Hearing a batch of petitions by BBMP, the Division Bench headed by Justice V G Sabhahit disposed of the petition for non-prosecution.
The appellants had challenged the single judge order dated June 30, 2009. The single judge, following a petition by Hutchison Essar South Limited challenging the order to levy tax on advertisements on shops and business establishments, had struck down the BBMP order and had directed the BBMP to refund the collected tax.
The petitioners had contended that the levy of tax was a violation of Section 134 of the Karnataka Municipal Act (KMC Act). The BBMP in its appeal had said tax could be collected under the KMC Act
