In the first complaint, Yeddyurappa is accused of  using his power and position to secure illegal pecuniary gain to his kin. He is charged with flouting all the rules, regulations and settled procedures, causing irreparable damage to the exchequer.

The accused

B S Yeddyurappa, N Akka Mahadevi, Mahabaleshwara N S, Sathyakumari, Mohan Raj, V Prakash, Kamakshamma, M Manjunath, V Anil Kumar, B Ramesh, Shantha Devi, Shantha Bai, Ismail Sheriff, V Manjunath and K Shivappa.

Instance 1

Illegal de-notification of land measuring two acres 5 guntas in survey number 81/3 of Arakere village, Bangalore South taluk.

It was later purchased by the people allegedly close to Yeddyurappa.
Though the Bangalore Development Authority (BDA) had acquired this land through a final notification dated July 28, 1990, it was denotified in the name of Sathyakumari and Mohan Raj  after they made a request. Yeddyurappa denotified the land on August 7, 2010.

The property was sold four days after the denotification. The estimated loss to the exchequer is put at Rs 46.50 crore and financial gains to the beneficiaries, Rs 25.39 crore.

Instance 2

Illegal denotification of land by Yeddyurappa in survey number 51/1 of Devarachikkanahalli for securing pecuniary advantage to his associate, K Manjunath. The BDA had acquired the land for BTM IV Stage Layout, converted the site to a civic amenity site and allotted it to Saira Educational Society. The estimated loss to the exchequer was estimated at Rs 26.50 crore and gains to the associates, Rs 14.16 crore.

Instance 3

Illegal denotification of land in survey number 42/1A2, 42/4A2 and 42/2B at Geddalahalli for securing benefit to Yeddyurappa’s associates, V Manjunath and K Shivappa. The land had been acquired for Arkavathy Layout. The estimate loss to the exchequer was Rs 52.27 crore.

Cumulative loss to the exchequer from all the three instances: Rs 125.27 crore.

Second complaint

The second complaint accusesYeddyurappa of nepotism, cheating, criminal breach of trust, criminal conspiracy, abuse of official position, causing loss to the exchequer of the state, securing  illegal monetary gain to his kith and kin.

Instance 1

BDA land measuring two acre 5 guntas in survey number 149 of Agara Village, Begur hobli, Bangalore South Taluk denotified by Yeddyurappa to benefit his son-in-law R N Sohan Kumar.

Later it was converted for residential purposes and sold to Elyon Developers Pvt Ltd., represented by its director S S Ugendar. Ugender had paid a sum of Rs two crore to Bhagat Homes Private Limited (BHPL) owned by Yeddyurappa’s sons and son-in-law.
Balaji Krupa Enterprises owned by Krishanaiah Setty paid Rs three crore to BHPL and Rs 2.50 crore to Davalagiri Property Developers Pvt Ltd and BHPL in return for change of land use from agricultural to residential to form a layout for Karnataka Telecom Department Employees’ Co-operative Society Ltd.

 Praveen Chandra to paid Rs 2.5 crore to BHPL and Rs 3.5 crore to Davalagiri Property Developers Private Limited in return for allotment of industrial lands by Karnataka Industrial Areas Development Board in Shimoga district and grant of mining lease for iron and manganese ore in Chitradurga district.

Estimated loss to the exchequer was Rs 74.05 crore and pecuniary gain was Rs 14.60 crore

Instance 2

Securing immovable property for Health Zone Advisors (India) Pvt Ltd in survey numbers 36/1 and 37/2 of Rachenahalli as a quid pro quo for denotification of lands at Rachenahalli village.

Namratha and S S Ugendar are said to have purchased valuable land from persons whose properties have been denotified by Yeddyurappa at Rachenahalli village, KR Puram through Health Zone Advisors (India) Pvt Ltd. Namratha and Umadevi, the daughter of Yeddyurappa are the promoters of Candor Business Solutions Private Limited.

R Suguna and her family members are the largest beneficiaries from the denotification of the lands ordered by Yeddyurappa. As a quid pro quo for the denotification of the lands, R Suguna and Manyata Promoters Private Limited have subsequently sold these lands to Health Zone Advisors, a company established by the family members of Yeddyurappa at a throwaway price.

Estimated loss to the exchequer was Rs 34.41 crore and pecuniary benefit was Rs 31.86 crore.

Instance 3

Pecuniary advantage to Sahyadri Health Care and Diagnostics Private Limited for illegal denotification of land in survey number 121, Uttarahalli, Bangalore.

Sahyadri Health Care and Diagnostics Private Limited (SHC&DPL) has B Y Vijayendra, Sagar Health Care and Diagnostics Limited Private Limited and B Y Raghavendra as shareholders. As per the financial statement of SHC&DPL for the year ending March 31, 2010, the company received a sum of Rs 335 lakh in the form of share application money from Sagar Health and Diagnostics Pvt. Ltd.  The share application money received was in return for denotifying the land in survey number 121 of Uttarahalli village held by Dr Hemachandra Sagar.

This land had been notified for the formation of Banashankari fifth stage residential layout. Dr Hemachandra Sagar misused his official position and ensured that the possession of the land was not taken over by the BDA.

Estimated loss to the exchequer was Rs 175 crore and pecuniary gain was Rs 3.35 crore.

B Y Raghavendra & B Y Vijayendra: Sons of B S Yeddyurappa, who established several companies, mainly Dhavalagiri Property Developers Private Limited and Sahyadri Health Care and Diagnostics Pvt Ltd. These companies received money from others in return for favours like denotification of land.
 
R N Sohan Kumar: Husband of BSY’s daughter Uma Devi. Represented Bhagath Homes Private Limited. Money paid to the company in the form of share application money by others in return for denotification of land. 
 
Krishnaiah Setty: Former Minister for Housing and Muzrai, Proprietor of Balaji Krupa Enterprises and developer of the Karnataka Telecom Housing Cooperative Society. Paid money to Dhavalagiri Properties and Bhagath Homes in return for getting agricultural land converted to residential area for developing a layout for the Telecom Society.
 
Hemachandra Sagar:  Sitting MLA from Chikpet assembly constituency and chairman of Sagar Health Group. Paid money to Sahyadri Health Care and Diagnostics in the form of share application money. This money was paid in return for getting land in Uttarahalli denotified.
