Rs 19 lac compensation to parents who lost son in road mishap

Thane, Nov 2, (PTI) :

Aged parents of a 20-year-old youth who died in a road mishap in 2007 have been awarded a compensation of Rs 19.70 lakhs by the Motor Accident Claims Tribunal here.

The Tribunal while deciding the claim ruled that both the victim and the driver were equally responsible for the accident which claimed the life of the youth who served as a Quality Coah in Spanci Tele Systems, a firm in the city.

In his order, Judge S Y Kulkarni also ordered that an interest at the rate of seven percent be paid from the date of application till the time of realisation and of the total amount realised, 50 percent be paid individually to the mother and father. And the balance be invested in a FD in their names for five years.

The applicants Walter Alexander Lobo (55) and his wife Hilda (50) told the court that on the ill fated day of February 26, 2007 their son Colin working as a Quality Coach was returning home on a motorcycle from Vashi to Kharghar by the Palm Beach road.

When the motorbike reached Nerul, a dumper coming from Koraj residency collided with the motorcycle, as a result of which the bike got stuck between the diesel tank and middle wheels of the dumper.

The applicants also alleged that the driver of the dumper was rash and negligent besides being in excessive speed which resulted in the accident. Colin who was admitted to a hospital died on March 3, 2007, while undergoing treatment, they said.

They claimed a compensation of Rs 30,00,000 following death on account of alleged negligence of the dumper driver.

The earlier owner of the dumper Raj Mohammad Yusuf Patel, of Bhiwandi and present owner Dilip S Moreya of Dahisar besides Oriental Insurance Company were opponents in the case.

While the Insurance company was represented in the case the owners remained absent and hence
it was decided exparte against them.

The claimants informed the court that the victim earned around Rs. 25,000 per month and assisted the family. They also told the court that they had incurred medical expenses to the tune of Rs 3.50 lakhs for the treatment.
