CIC order to make public CFSL reports on Bhushans' CD stayed
The Delhi High Court today stayed the Central Information Commission order directing the Delhi Police to make public the forensic reports on a CD, purportedly containing conversation among senior lawyer Shanti Bhushan and politicians Amar Singh and Mulayam Singh Yadav.
Justice Vipin Sanghi stayed the CIC order till February 24 on an appeal by the Delhi police challenging the panel's November 14 order and issued notice to RTI activist Subhash Chandra Agarwal, seeking his reply by February 24.
Appearing for the city police, Additional Solicitor General A S Chandhiok told the court that investigating agency cannot comply with the CIC order as the matter is sub-judice before a trial court.
The CIC had directed the Delhi Police and the CFSL, Chandigarh to make public forensic reports on the allegedly doctored CD, carrying purported conversation between the two politicians and the lawyer.
The Chandigrah forensic lab, however, has already revealed its report on the CD, reportedly certifying it as doctored.
The Delhi police had got the CD examined twice at two different forensic laboratories and had claimed that the reports certify the CD as genuine. The police, however, had not made public either of the two reports.
The police had also sent the CD to Chandigarh forensic lab, which has allegedly termed the CD as doctored.
The CIC order had come on the RTI activist's plea, seeking the panel's direction to the Prime Minister's Office, Home Ministry and the CFSL, Chandigarh to make public the forensic reports on the CD in which Shanti Bhushan is allegedly telling Yadav and Singh that his son Prashant can "manage a judge".
