SC will hear Gujarat govt plea on Lokayukta
The Supreme Court on Friday decided to hear the Gujarat government’s plea challenging the governor’s decision to appoint Justice (Retired) R A Mehta the Lokayukta.
A bench of Justices B S Chauhan and J S Khehar admitted the petition of the state government challenging the Gujarat High Court order.
The court said it would examine the matter at length as it involved the vital question of Constitutional law. The bench has put the matter for hearing on February 20, 21 and 22.
Gujarat government had earlier contended that the decision was “unconstitutional”. “The governor, while exercising function under Section 3 of the Gujarat Lokayukta Act, 1986, is to act on the aid and advice of the council of ministers headed by the CM and is not required to exercise the said function in the individual and personal capacity and discretion,” the plea maintained.
