The Special Lokayukta Court on Saturday issued summons to former chief minister B S Yeddyurappa, his sons B Y Vijayendra and B Y Raghavendra, son-in-law R N Sohan Kumar and former minister S N Krishnaiah Setty for their alleged role in an illegal denotification of land case.

With the issuance of the summons, the trial is set to begin in the first of the private complaints filed by advocate Sirajin Basha on March 3 last.

Dhavalagiri Properties is also named as one of the accused in the case and the summons to Raghavendra, Vijayendra and Sohan Kumar will indicate summons to Dhavalagiri Properties as well, as they are listed as directors of the company.

The complaint was filed on January 22, 2011. The court, after taking cognisance of the complaint, had handed over the inquiry into the case to the Lokayukta police on March 24 last. Following this, inquiry officer Abdul Ahad submitted a 1500-page report to the court in October 2011, saying that allegations were proved in two instances related to illegal denotification of land. Charges could not be proved in one of the instances relating to the amalgamation of a public road in Nagawara Layout.

Yeddyurappa and others have already obtained anticipatory bail in this case from the High Court of Karnataka.

In the first of the three instances, Sirajin has alleged illegal denotification of  one acre 12 guntas in survey No 55/2 of Rachenahalli, KR Puram hobli, Bangalore East taluk, acquired by the Bangalore Development Authority for the formation of the Arkavathy Layout, to benefit Yeddyurappa’s sons and causing a loss of Rs 19.60 crore to the exchequer.

The second instance relates to the alleged illegal denotification of 16 guntas in Survey No 56 situated at Rachenahalli and later sold to Dhavalagiri Properties causing a loss of Rs eight crore. In both instances, Krishnaiah Setty had obtained general power of attorney from the original landowners and applied for denotification of land.

The third instance relates to the amalgamation of public road belonging to Vyalikaval House Building Co-operative Society in Nagawara Layout to benefit Dhavalagiri Properties, causing a loss of Rs 24.26 crore to the exchequer.
