<p>Former MLA Vijaykumar Shetty claimed that there was gross violation of building laws in a commercial building situated in survey number 14/7C (P1) and 14/7 C(P2) at Kottara Chowki in Brangra Kuloor grama. <br /><br /></p>.<p>Addressing a press meet, he said that the building is owned by Chief Minister D V Sadananda Gowda. He alleged “the DSK Complex is situated adjacent to the National Highway. There is a six metre road beside the building which leads to Akasha Bhavan. <br /><br />However, the building has encroached the public road, causing severe inconvenience to the public. The road was providing easy connectivity to the National Highway for the residents of Jalligudde region. The building has violated the national building code by not providing adequate set back area. It has deviated from the original plan.” <br /><br />He said “the MUDA officials demand for set back area even for a house constructed in two to five cents land. However, here when there was gross violation by the building owner, the MCC and the MUDA has kept quiet. If there was any deviation from the original plan, the MCC orders for the demolition of the building. While issuing completion certificate, if the officials had real concern for law, they should have ordered for the demolition of the building,” he added. <br /><br />He alleged that the CM is misusing his power. “We will file a complaint with the Lokayukta asking Lokayukta to probe into the matter.” <br /><br />He said “the parking lot in the building has been converted into a workshop.”<br /><br />Counter claim<br /><br />Ashok Kumar Rai, co owner of the building said “the building built on survey number 14 has not violated the rules. The building was not constructed by encroaching the public road.” <br /><br />He said “D V Sadananda Gowda had purchased 16 cents land by following all the legal procedures. As required, set back has been provided and building was constructed in 14 cents land. After completing the building, we have obtained completion certificate from the Mangalore City Corporation. Neither the MCC nor MUDA had acquired land for the construction of a public road. We will not allow the construction of public road in a private land without acquiring the land legally. We are allowing the public to use the vacant space beside the building on humanitarian ground.”</p>
