Advocate K S Aril, who is the consumer, had purchased a Nokia mobile handset by paying Rs 6,500 in 2004 and the same handset was insured with National Insurance Company. Meanwhile, his handset was stolen three months after the purchase and as per procedure, he filed a complaint at the nearest police station. However, the insurance company refused
to pay compensation to Aril, when he made a request in writing.

When Aril filed complaint at the DCDRF, the court directed the insurance company to pay Rs 6,500 as compensation and Rs 5,000 fine along with 10 per cent interest to the complainant. The State Consumer Redressal Forum had upheld the district forum’s directive after hearing insurance company’s appeal. Later, the NCRC too directed the insurance company to pay the compensation to consumer, recently.
