Notices to Shettar, BSY, Gowda

Bangalore, May 4, 2013, DHNS:

A local court on Saturday ordered issue of notices to Chief Minister Jagadish Shettar, former chief ministers B S Yeddyurappa and D V national president Rajnath Singh and State president Pralhad Joshi.

The vacation City Civil and Sessions Judge Shivashankar Amarannanavar ordered issue of notices, while hearing a suit filed by T J Abraham and 12 others. The complainants in their class suit stated that they had voted in the 13th Assembly elections held in 2008 for the BJP, on the faith induced by BJP that its election promises were solemn and that it would perform those promises if it was voted to power in the State.

“Once elected to power, BJP has proceeded to breach most of the solemn election promises that were previously pledged by it and .... has chosen to wantonly, deliberately, recklessly and intentionally disregard the very election promises that constituted the basis for it to secure the highest number of seats in the 13th Assembly,” the complainants alleged.

They contended that the class at issue were all voters who were eligible to cast votes in the elections held to the 13th Assembly in 2008 and “cast votes in favour of candidates set up by the BJP political party by principally relying upon the BJP’s election promises as stated in its promise sheet and who have since been injured and have sustained damages by reason of the BJP’s wanton breach of those very election promises, while granted the power and opportunity to perform it all.”

The plaintiffs sought the permission of the Court to collectively plead the cause of action and to prosecute the suit from definite members of the public in terms of Order 1 Rule 8 of the Code of Civil Procedure, 1908 and compensatory damages.
