Chief Justice urged to defer SC rules 2013

The Supreme Court Bar Association (SCBA) has urged the Chief Justice of India to defer implementation of the amended SC rules, scheduled for August 19, in order to hold “effective and comprehensive” consultation with lawyers’ association.

The apex court’s lawyers’ body expressed its “surprise as well as dissent” over the decision to go ahead with the changes in the Supreme Court rules 1966, having “huge ramification over the litigating public” and the member of the bar.

A meeting of the executive committee held on July 24 passed a resolution stating that it was “saddened” that the SC Rules 2013 have been made without inviting any suggestions or even views whatsoever either from the member of the SCBA or even with 21 elected representatives.

“It is very surprising that SC rules 2013 have been sent to the office-bearers, the President and Honorary Secretary on SCBA on July 22, much after the notification dated May 27, 2014 have been published,” it said.

Article 145 of the Constitution, as far as SC rules are concerned, empowers the SC to make rules for the practice and procedure of the SC and the President acted on the advice of the SC.
