Court reserves order on Salman's DL till March 3

Prosecution wants actor to produce DL

The Mumbai sessions court on Friday reserved till next Tuesday its order on the prosecution’s plea seeking a direction from the trial judge asking actor Salman Khan to produce his driving licence.

D W Deshpande, who is conducting the retrial, would decide on the application on March 3. Earlier, the case was partially conducted before a magistrate’s court before the charge of culpable homicide not amounting to murder.

On September 28, 2002, Khan rammed into the pavements along the A1 Bakery at Bandra, killing one person and injuring four others.

According to Public Prosecutor Pradeep Gharat, Khan did not possess a licence during the accident and obtained a driving licence only in 2004, as per the record available with Regional Transport Office.

Salman’s lawyer Srikant Shivade opposed the prosecution’s application saying that it was not maintainable.

Khan’s lawyer opposed the prosecution’s application saying it violated the fundamental right against exploitation enshrined in the Constitution as it had asked the accused to produce documents incriminating him. “The prosecution should prove its case that Khan was not holding driving licence without asking him to produce it,” he said.

Meanwhile, Gharat also argued his case to bring on record statements of two crucial witness – police bodyguard late Ravindra Patil, who was assigned to protect the actor and Dr Sanap, who had conducted the post-mortem of the victim. While Dr Sanap has retired and settled in the United States, Patil is no more.
