HC relief to 39 MBBS seat aspirants

 The High Court on Tuesday directed Father Muller Medical College in Mangaluru to admit 39 students, whose admission to MBBS course in 2015-16 was termed invalid, during the academic year 2016-17.

A division bench comprising Justices Jayant Patel and B Sreenivase Gowda directed the college to allot seats to these 39 students from the 50 additional medical seats that have been sanctioned to it for the year 2016-2017.

Father Muller Medical College had admitted 13 students selected through CET and 26 students selected through Comed-K during the academic year 2015-2016. These admissions were not approved as the Medical Council of India (MCI) rejected the permission to the college for 50 additional seats. Subsequently, the college challenged the MCI order before the Delhi High Court, which passed an interim order allowing the admission of the students. The MCI challenged the admissions to these 50 additional seats in the Supreme Court. The apex court struck down the 50 admissions.

Later, the 13 students selected through the CET approached the Karnataka High Court seeking relief. Hearing their petition, the bench on Tuesday directed Father Muller Medical College to surrender 39 seats to the government from the 50 additional seats sanctioned to it for the year 2016-2017 and admit these students as per the norms of Comed-K. The bench directed the college to collect a fee of Rs 5.45 lakh each from the 13 CET candidates for this academic year.
