The Supreme Court on Friday issued notice to the Tamil Nadu government on a plea filed by DMDK party leader Captain Vijayakanth, challenging a defamation complaint against him in Dharmapuri district.
Though the apex court had upheld the constitutional validity of criminal defamation provision, the role of public prosecutor for granting sanction must remain independent, he said.
Solicitor General Ranjit Kumar also submitted that a complaint cannot be filed under routine manner to harass a citizen under the law.
