Govt urges SC for no action on Shunglu report

The Delhi government on Monday urged the Supreme Court that there should be no precipitative action on the Shunglu Committee report till the issue relating to power tussle with the Centre was adjudicated upon.

A bench of Justices A K Sikri and Abhay Manohar Sapre, which did not pass any order, put the matter for consideration on December 5.

Senior advocate Gopal Subramanium, appearing for the Delhi government, said that the Committee has submitted its report to the Lieutenant Governor on Sunday and there were certain apprehensions about it.

He also sought stay on the report of the panel headed by former CAG V K Shunglu and also comprising ex-Chief Election Commissioner of India N Gopalaswami and ex-CVC Pradeep Kumar as members.

The Committee was set up by LG Najeeb Jung on August 30 to examine over 400 files on decisions taken by AAP regime.

Solicitor General Ranjit Kumar, appearing for the Centre, submitted the report was filed on Sunday only and nobody knew what its contents were.

Senior advocate Indira Jaising, also representing the Delhi government, submitted the court should consider referring the matter to the Constitution bench as the issues involved constitutional process, rule of business and the NCT Act.

“We will consider all issues on December 5,” the bench said. The National Capital Territory government had approached the apex court against the Delhi High Court’s August 4 ruling that Delhi continued to remain as Union Territory with the LG as its administrative head with wider discretion than Governor of a state.

The apex court had on September 9 refused to stay the HC’s judgement, pending the Delhi government’s appeal.
