AIMPLB for social boycott of those using triple talaq

No mention of abolishing practice

 The All India Muslim Personal Law Board (AIMPLB) on Monday told the Supreme Court that those resorting to ‘triple talaq’ will face “social boycott” and that Qazis will be asked to advise grooms against resorting to this practice.

The board, however, did not speak about abolishing the centuries-old practice.In an affidavit, the AIMPLB told the apex court, “At the time of nikah, Qazis will advise bridegrooms that in case of differences leading to talaq, the bridegroom shall not pronounce talaq in one sitting.”

The Qazis (who are considered judges of Sharia court) will advise the bride and groom to incorporate a condition in the ‘nikahnama’ that they will not resort to ‘triple talaq’.

The affidavit said a dispute between husband and wife should be settled through “mutual interaction” and a code of conduct on this has been released by it, keeping in mind the tenets of the Shariat.

Board to issue advisory

On Thursday, just before the Supreme Court concluded its hearing and reserved the judgement on the validity of triple talaq, the AIMPLB had told the apex court that it does not want the practice to continue and would issue an advisory.

Senior advocate Kapil Sibal had submitted before a five-judge bench presided over by Chief Justice of India J S Khehar: “We do not want the practice to go on. We have held a meeting yesterday (Wednesday) and will send a circular to all the Qazis within a week to mention it in nikahnama that it would not be permitted.”

Earlier, the AIMPLB had argued that the top court should stay away from adjudicating on the issue as it concerned the religious rights of Muslims under the Constitution.

The five-judge Constitution bench is expected to peruse the affidavit, which marks a shift in the approach of the AIMPLB.

The AIMPLB said an advisory to the Qazis would be issued through its website, publications and social media platforms.
