Karnan seeks remission of 6-month jail sentence

Former Calcutta High Court judge Justice C S Karnan on Tuesday urged President Ram Nath Kovind to remit the six-month jail term awarded to him by the Supreme Court’s nine-judge bench on May 9 for contempt of court.

“Nowhere in the world, a person accused of an offence could have been sentenced without a charge, without a lawyer, without his presence secured, without a judgement, nay, a judgement being authored after the execution of the sentence. Justice Karnan’s case could be the sole exception,” stated a letter petition sent by advocate Mathews J Nedumpara and others.

The petition, claimed to have been sent on behalf of Justice Karnan, further contended, “Your Excellency being a lawyer for more than half a century, an Advocate-on-Record of the Supreme Court of India, will be shocked by the injustice done to Justice C S Karnan and more than that the flagrant violation of the constitutional provisions by none other than the institution of

Supreme Court, the very protector of the Constitution and the law.” The counsel sought the President’s intervention by remitting the sentence or suspending it till the review and recall application filed by Justice Karnan.
