HC stays sanction to prosecute Kalladka

The High Court on Tuesday stayed the sanction granted by the government for prosecuting RSS leader Prabhakar Bhat (Kalladka Prabhakar Bhat).

Bhat moved the court challenging the sanction order and lower court proceedings against him. He is accused of triggering communal unrest through his hate speech in Belthangady of Dakshina Kannada district. He had contended that the government granted the sanction to prosecute him to seek political revenge. Justice Aravind Kumar granted stay on the prosecution sanction order.

Government ssanction is required for cases registered under Sections 153A and 505(2) of the Indian Penal Code.

SC bench for RERA cases

The counsel for the Central government informed the high court on Tuesday it had been proposed that all petitions challenging the Real Estate (Regulation and Development Act), 2016, be heard by a Supreme Court-designated bench. The counsel submitted that a number of petitions have been filed in high courts across the country challenging the Act. Since it is a Central legislation, it had been proposed that the matter be heard by a bench designated by the apex court.

The petitioners had sought declaring provisoins in the act applying to housing societies unconstitutional.
