HC rejects Nalapad's bail plea

The court based its verdict on CCTV footage.

The Karnataka High Court on Wednesday dismissed the bail petition of Mohammed Nalapad Haris, prime accused in the Bengaluru pub assault case.

The court based its verdict on the grounds that the CCTV footage of the incident shows the horrendous atmosphere created by Nalapad and his aides and that there is no guarantee that such people will not tamper with the evidence if they are released.

While rejecting the bail, Justice Sreenivas Harish Kumar stated that Nalapad, being the son of MLA N A Haris (Congress), wielded his muscle power by brutally assaulting the victim, Vidwath L.

The order further states that there are prima facie materials to link Nalapad with non-bailable offences such as Section 306 (voluntarily causing grievous hurt by dangerous weapon) and Section 307 (attempt to murder) of the Indian Penal Code (IPC).

The judge also stated in his order that the sessions court had given cogent grounds for rejecting bail and thus the high court cannot interfere with the reasons assigned by the session judge's decision.

The order further stated that the incident was not a case of a "drunken brawl" and that the injuries sustained by Vidwath are grievous in nature.

The order stated that the major aspects considered for not granting bail are character and position of the accused and reasonable apprehension of tampering with the witnesses and the evidence.

Nalapad and six of his associates surrendered a day after brutally assaulting Vidwath on February 17 at Farzi Cafe in Bengaluru.

He was charged under Section 307 of the IPC (attempt to murder), among other provisions.

Nalapad's bail plea was rejected by the City Civil and Sessions Court on March 2 following which he had approached the high court.

Nalapad's counsel Usman P told DH that they are yet to decide the next course of action.
